Wheelchair Rental Agreement and General Terms and Conditions
1. Parties
This Agreement is entered into between Vienna Wheelchair Rental (hereinafter referred to as “LESSOR”) and the person/institution receiving the service (hereinafter referred to as “LESSEE”) under the terms set forth below. The Lessee is deemed to have accepted these terms when requesting wheelchair and equipment rental services via the website or any other communication channel.
2. Subject of the Agreement
The subject of this agreement is to determine the terms and conditions for the rental service of the product/equipment requested by the Lessee for the specified period.
3. Rental Period
The rental period covers the time between the start and end dates specified in the rental form.
The minimum rental period may vary depending on the rented product and is specified at the time of order.
If the Lessee wishes to extend the rental period, they must notify the Lessor and obtain approval at least 48 hours before the expiration of the rental period. Extension requests are evaluated based on product availability and are subject to additional charges.
4. Pricing and Payment
The product rental fee is calculated based on the daily, weekly, or monthly rates specified on the website. Additional shipping fees may be charged for delivery and return.
VAT and Shipping are NOT included in our prices.
The total rental fee is collected in advance (via Cash, Credit Card, or Bank Transfer/EFT) at the beginning of the rental.
A deposit fee, determined according to the nature and value of the rented product, is requested from the Lessee. This deposit will be refunded to the Lessee at the end of the rental period, provided the product is returned undamaged, complete, and in accordance with the contract terms.
5. Delivery and Return
The rented product is delivered to the address specified by the Lessee by the Lessor and is picked up from the same address.
The Lessee is obliged to check that the product is intact and in working condition upon receipt. Any defects or damage detected during delivery must be noted on the delivery form. Otherwise, the product is deemed to have been delivered in good condition.
The Lessee is obliged to return the product at the end of the rental period as received: clean, intact, and complete with all accessories.
In case the product is returned excessively dirty, a cleaning fee of [25%] may be deducted from the deposit.
6. Responsibilities of the Lessee
The Lessee accepts and undertakes to use the rented product/equipment solely for its intended purpose and with care.
Sub-renting, selling, or transferring the rented product to third parties is strictly prohibited.
Any damage (impact, falling, breaking, tearing, etc.), loss, or theft that may occur during use is entirely the responsibility of the Lessee.
The repair cost of the damage or the current market value of the product in case of loss/theft is primarily deducted from the deposit. If the damage cost exceeds the deposit, the excess amount shall be paid separately by the Lessee to the Lessor.
The Lessee cannot make any changes or repairs to the product without the permission of the Lessor. In case of any malfunction, they must contact the Lessor immediately.
It is prohibited for the Rented Equipment or Wheelchair to be used by untrained or unconscious persons.
7. Responsibilities of the Lessor
The Lessor undertakes to deliver the product/equipment subject to the rental to the Lessee in a maintained, clean, and working condition.
The Lessor is obliged to provide the Lessee with the necessary basic information regarding the correct and safe use of the product.
The Lessor cannot be held responsible for accidents, injuries, or material/moral damages resulting from the use of the product (due to misuse, carelessness, etc.).
8. Late Return
In the event that the Product/Equipment is not returned on the rental end date, a delay fee of [50% more] than the standard daily rental fee will be invoiced to the Lessee for each day past without notice.
For delays exceeding [7 days], the Lessor reserves the right to take legal action without the need for any further warning.
9. Cancellation Policy
For cancellations made more than 48 hours before the start of the rental, the entire fee paid will be refunded.
For cancellations made between 24 to 48 hours before the start of the rental, 50% of the rental fee will be deducted, and the remainder will be refunded.
No refund will be made for cancellations made less than 24 hours before the start of the rental or if the Lessee fails to receive the product.
10. Competent Court
Vienna Courts and Enforcement Offices are authorized for the resolution of any disputes that may arise from this agreement.
